1. Agreement to Terms
By using our services, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, do not use the services. We may modify the Terms at any time, and such modifications shall be effective immediately upon posting of the modified Terms.
2. User Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service. You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.
3. Subscriptions
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a subscription. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Atkins Media cancels it.
4. Intellectual Property
The Service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of Atkins Media and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Atkins Media.
5. Limitation Of Liability
In no event shall Atkins Media, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
